Credit Card Receipt Violations
FACTA is The Fair and Accurate Credit Transactions Act of 2003. This federal law added sections to the Fair Credit Reporting Act (FCRA). The act is intended primarily to help protect consumers from identity theft. Identity theft is a huge and growing problem. One 2016 study found that 13.1 million American adults were the victim of identity fraud in 2015. Contact us today if you need a FACTA Lawyer.
FACTA strengthens consumer protection against identity theft. For example, FACTA provides that "no person that accepts credit cards or debit cards for the transaction of business shall print more than the last 5 digits of the card number or the expiration date upon any receipt provided to the cardholder at the point of the sale or transaction." In practice this means that vendors who take credit card payments must not print the expiration date of your card or any of the numbers of your credit card except the last five digits. If they do they are endangering your privacy and increasing the likelihood that some thief will use your credit card information. The law provides that vendors who print too much of your credit card information can be sued in civil court and may have to pay you statutory damages of $100 to $1,000 as well as punitive damages and attorney's fees. The law provides for these remedies for a reason: allowing civil suits is the most efficient way of policing companies so that they protect your information.
We help protect consumers by suing vendors and companies who violate FACTA. Check your receipts. If you paid for something with a credit card and the receipt shows more than five digits of your credit card number, or if the receipt shows the expiration date of your credit card, then Contact Us. We can help you recover a cash reward and protect consumers.
